Second family files suit in fatal double-decker bus accident



CHARLESTON — A second lawsuit has been filed in Coles County Circuit Court related to a pair of deaths on a local double-decker bus in May.

The family of Justin M. Sleezer of Plano is placing liability for his death on the companies, owner and driver of the bus that traveled under the Interstate 57-Illinois Route 16 overpass bridge on the night of May 30. A similar lawsuit was filed earlier this month by the family of Cameron L. Chana, an Eastern Illinois University student from Clarendon Hills.

The new lawsuit, nearly identical to the one filed by the Chana family, accuses negligence on the part of Lincoln Springs Resort, Graywood Foundation, Graywood Enterprises, company owner Augustine G. Oruwari and John R. Protz, the driver of the double-decker bus that carried Chana, Sleezer and other young people during an all-day trip between Charleston and Lake Shelbyville in May.

Both Chana and Sleezer died in an Urbana hospital hours after their heads hit part of the I-57 bridge structure while they were on the open top deck of the bus.

The plaintiffs claim the route was a risk due to the bus height and low clearance of the highway bridge. In addition, precautions, including warning the passengers to sit down or moving them to the lower deck, were not taken that night, the plaintiffs state in court documents.

The bus owners have previously stated the route was safe and traveled several times without incident for upper deck passengers, and the bus driver did warn against standing up in the bus.

No monetary damages are specified in the Sleezer filing.

I care. You should have said "I" not "no one". If you don't like the rinky dink paper then don't read it. I don't understand some of the stupid remarks people make on these posts. They really don't contribute, they just make sure everyone knows that they are mean, cold hearted smart@##$% that everyone wishes would keep those kind of remarks to themselves.

I am against the lawsuit. I don't think people should sue when clearly these were adults that knew it was dangerous to stand up. Do you think being told or reading a sign would have made a difference? Did they REALLY need a babysitter? Would that have stopped them from standing at that moment. Doubtful. The boys made a stupid fatal decision. It's very sad, but the fact is, they are responsible for their own actions drunk or not. "

Everyone else on that bus was smart enough to stay seated so i do not see how the driver is at fault. People need to take responsibility for their actions. If my child got drunk at a bar and drove home and killed someone on the way, am i going to blame the bar for serving my child alcohol, no..my child was the uneducated one who got behind the wheel of a car drunk and hurt someone, it would be their fault and noone elses. I don't feel that these ADULTS needed to be babysat and that seems to be the argument of how the bus company and driver are at fault.

3rd--There are lots of people that care. Money may not bring those boys back, but it may give some kind of closure for those families.---seriously closure in the form of money, give me a break. Its not like these men were murdered anonymously, or kidnapped, they were killed in a terrible ACCIDENT that yes could have been prevented in many ways, but i don't see how winning money is going to bring the family closure. I find that theory a little ridiculus.

It is very tragic and i could never imagine loosing my child especially in such a terrible way and my prayers are with the families, however i still feel that they need to turn to other options of coping and responsibility, rather than looking for monetary compensation and to blame anyone but themselves or their Children. It is part of the grieving process to find blame wherever we can and that is ok, its how we choose to deal with it that makes the difference. "

" I've mentioned before that I've rented this bus before. Regarding the chaperon issue, the company gives you a choice to either accept the company's chaperon or to provide one of your own in their contract.

Obviously, if there was not a company provided chaperon on the upper deck of the bus, then these individuals chose to provide their own. I wonder who that was supposed to be. If you don't accept the company's chaperon, you are responsible to provide the chaperon and place them where you want them and then to abide by the rules and regulations that they give you.

They also explain the rules and instructions to you and they are pretty clear about them.

This type of lawsuit names everyone possible. Later on, the people or companies that don't apply will be dropped from the lawsuit. Let's just be patient to see how this plays out. It is too soon to blame anyone yet.

After all, the company might have some recourse in this also, I guess we'll have to see. "

The entire reason that Mr Oruwari built Lincoln Springs Resorts is so that it would help provide a wonderful place for clients and their families to spend time togther. When the site is 100% done there will be cabins for client's families to come and stay while they visit their family member who is a Graywood Client. The site is planning on having an on site store of some type so that the clients who are able to work can do so on the site. When I placed my son in Graywood I and my DCFS worker who helped me find a suitable group home for my child were told of the plans for Lincoln Springs Resorts. And let me tell you this much out of the 15 State Approved Group Homes I visited Graywood was the best one!! My son has been a resident in a Graywood home for the past 7 years and everyone involved in this company is wonderful! Their priority is taking care of their clients and they do a wonderful job of doing just that!! Also, for some of these kids and adults in the program the staff is the only family they even have!! Just as people ask for respect for these two young men's families I ask for respect for those of us who have a family member in the company's facilities. Bashing Graywood and Lincoln Springs resorts is not going to get anything settled. For those who say "people are defending the driver of the bus" the truth is unless we were there we only know the facts that were given to us from this paper or any other news source. This newspaper has reported on more than one occasion that the passengers were asked to sit down, their have been posters who have said they have ridden this bus and had no issues or problems and signed a waiver saying they understood the risks and rules. There is one "foolproof" way to clear the company and driver and to put an end to any question of liablity on their part, and that is to close off that section of road for a short time period, have the bus go under it with NO PASSENGERS and Videotape the bus going under the underpass!!! You will be able to quickly see if there is enough clearance for the bus alone to go under that paticular underpass! Then you repeat this using Maniquins SITTING DOWN on the Top level of the bus!! That will prove without a shadow of a doubt who truly is at fault for this terrible horrible tragic incident/ accident.

I am very sorry for the families and freinds of these young men who lost their lives. If I sound "biased" you darned right I am! Because Graywood was the answer to my prayers for my son!! If he had not been placed there he surely would have been dead, because he would run off from home and lay on the train tracks in Galesburg where we are from and there is a train every hour on the hour!! I had adults that could not get out of my many locks and alarms but my son could and did! Graywood has taught my son everything that every doctor has said he would "never do" I have seen my son whom I was told would never talk, talk and be understood by everyone around him, he has freinds and interpersonal relationships with caregivers which he was never supposed to do either, my son no longer cries all day long for no apprant reason, he is well cared for, and well loved. Graywood has given me back what I lost when my son was diagnosed with Autism and Moderate MR.. HOPE!! "

Actually my son lived with me until DCFS told me that either I put him in a group home or they do it for me. As I said, I had adults that couldn't get out of my house and my son still could! He would go and lay on the railroad tracks and that kid could outrun me whether I was on foot or in a car, Heck he could even outrun my dad on his motorcycle! I did try to get DCFS to find me "special help" and they balked at it, the state gave me respite help and my best freind my son's godmother lived with us and the DCFS worker and her boss told me "it didn't look apporiate to have two women living toghter" that was my freinds job and she stayed up all night with my son, I worked days while he was at school. I moved here to this town to be with my son, Galesburg where we are from is 3 hours away, and I do go see my son everyday. The people at his house are now part of his family so my son still does get "family care" and let me say this its a lot easier to keep your special needs child at home when you have extra help, my parents both worked two jobs, my ex husband refused to do anything to help and other than my son's godmother everyone else had to work by the time they got off work everyone was too tired from working all day long to come by and "help" Placing my son in a home was not my first choice but it has proven to be the best thing for him! "
