Sheriff: Homeowner kills armed robbers

INDIANOLA (AP) — Police say an eastern Illinois man shot two people to death after they forced their way into his home and tried to rob him.

Vermilion County Sheriff Pat Hartshorn says the two masked men held the homeowner on the floor at gunpoint Monday night and choked him while demanding money. The sheriff says the alleged robbers were 22 and 17 but didn’t identify them or the homeowner.

Hartshorn says the men let the homeowner go when his wife said she had expensive jewelry upstairs. While the men focused on a jewelry box, the homeowner grabbed a handgun and shot them.

Hartshorn says another 17-year-old waited in a pickup outside. He drove away but was arrested a short time later.

Indianola is about 10 miles southwest of Danville.

But according to the WCIA newscast last night the homeowner was a retired cop so I do have to wonder if it had been an average person who shot and killed an intruder would they have been brought up on charges of some sort? I hope not, but in this day it seems the criminal has more rights than the victims. "

His wife heard the commotion and came down stairs to investigate, when she saw her husband being beaten she convinced the intruders that she had jewelry upstairs and she would open the safe for them if they stopped beating him. Once upstairs the homeowner retrieved a handgun and when the 21 year old swung the shotgun his way he shot multiple times killing him on the spot. He then chased the unarmed 17 year old down stairs and shot him multiple times in the back as he was trying to escape. "

The robbers got a big surprise, maybe this incident will make some other CRIMINALS think twice before they try to rob some other INNOCENT people. "

As far as I know folks have the right to protect themselves or their property, in or on their property. But FOID had better be kosher, gun records, and any other stuff, possibly even a valid hunting license.

Perhaps the paper should get the SA on the record for what counts as legaly defending your home, and what might face charges. Is the screen door the deciding factor? Does it make any difference if it is in town or rural? Can simply holding them at gun point for law enforcement to come and collect, have any legal problems for the homeowner? Send Rob S to do the story, he is the best reporter in the stable most of the time.

Subsequent reports so far have no charges filed or pending for shooter, and 17 year old get away driver waiting outside to be charged as an adult for home invasion. "

Could the victim in the sleepwalking case?

Do you have to be physically threatened, see a weapon, or is breaking in, unlawfull entry, or trespassing enough?

Are vandals on your property fair game?

What if its going on at the neighbors and you wind up having to decide?

Will a warning shot, find you charged?

Not knowing clearly ahead of time, could cost your guns, freedom, or huge legal expenses for someone elses criminal behavior or stupidity.

I think there have been legal issues with even holding an intruder at gunpoint for law enforement to come and collect.

People should have the right to defend themselves and their property, but knowing what the lines for doing it are more clearly, could avoid several potential issues, legal or civil.

Sometimes it seems to largely depend on what jurisdiction it happens in. So understsnding the SA and law enforcements insights on when it is and when it isn't wrong to use deadly force, or other means, would protect some folks from crossing any fine lines that might find them winding up charged, sued, or no guns the next time.

The heat of the moment usually turns into what it will. Hesitating or rushing to act can both inadvertantly turn tragic or costly.

Even being completely in the right, this hero, now probably has a pretty heavy load from this chain of events.

The criminals brought this completely on themselves with their actions. Hopefully it has a lasting impact and many think twice about crime. "

Come on now fb and HP. I'm not semi-literate. Actually I read very well. While I admit my neck can get extremely pink at times, that in and of itself is not a bad thing.

I own guns. I have an up to date FOID card. While I would not relish being put in the position of having to defend myself or my family with them, I wouldn't hesitate to do so if the situation warranted it. Thankfully I've never been in that position and I hope I never am.

Mike P, I sure as hell am not going to take the time to go down the list of "what ifs" if some jerk has broken into my home and is threatening me and mine. By the time one goes through that check list it may be too late. If in my judgement I'm in danger I am not going to take the chance that I can "reason" with the invader. While doing so the CRIMINAL could very well take my weapon and use it on ME. I'll take my chances on being charged with a crime for defending my family later.

If that makes me a semi-literate redneck or a nutcase, so be it. "

I do not see the insanity in a person protecting their wife and property. However, I am sure that you would try to establish dialogue with home invaders while they beat and robbed you or possibly right before they put a shotgun to your head and ended your lives. That seems rather insane to me. But what can I expect from people who support organizations like ACORN who teach people how to establish houses of prostitution that would use underage latinas as sex slaves. I guess expected more from Lake Land College graduates fellahs, come on. "

Mike P wrote on Sep 24, 2009 8:05 PM:

" I hope none of us have to deal with crime of any kind, especially a home invasion.

I just like to know the rules, rather than chance unnecessary further compounding issues. I am that way with hunting, and other gun issues too.

I figured this story might be not so close to home enough, to get some clarification on stuff I've heard.

The sheriff there said people have the right to defend themselves in their homes. I have tried to find some clarification on some of the issues I mentioned, and haven't had any luck at all.

I have lots of hearsay, but no clear answers.

I know someone from another county whose home was broken into ransacked, and they tried to start his vehicles on fire, while he was gone. When the sheriff came to make the report, he suposedly said it was fine to shoot people doing stuff like that if caught on the property doing it.

I have heard they have to be inside the door of your home. I have heard they don't have to be. I would rather know, than just depend on the system to decide for me, because I went with what I heard was the law.

Many folks have a bit more than a few minutes response time from calling 911, and can't wait for professionals to showup to handle it.

Since this was a smalltown, 10 miles from Danville and the sherrif is handling it, I suspect the response time there may be delayed there, and simply waiting would have added to the risk already present. You don't know how many more are outside, in the get away car, or if any still are. "

greeneyesofmarch wrote on Sep 24, 2009 8:39 PM:

" I moved here to Mattoon from Indianola and can tell you that it would of taken quite a while for the county to show up. Indianola itself only has about 250 people. It is a very rural area, especially the outskirts.

I am thankful that the homeowners are ok.

If it were to happen at my house I wouldn't even think twice about pulling a trigger on someone that forced their way into my home, armed and intending to harm myself or my family.

If I were asked why I shot them 5 times I would simply say that is when I ran out of bullets! I would take no chances of them pulling out a hidden weapon.

Unfortunately like everywhere atleast one of the criminals had quite the rap sheet and obviously had been slapped on the hand by the courts too many times instead of getting kicked in the ---!

Thankfully I was raised on a farm and my grandfather thought that all of us should know how to handle and respect a gun....even us girls! "

The problem is, the criminal element is not going to respect these regulations and laws. The responsible citizens will be the ones penalized with more and more "sensible" gun regulations. They will keep chip chip chipping away until no one will be able to own a firearm. The thugs will continue to buy most of their weapons illegally off the street and be armed. The laws we have now need to be enforced, not more useless and redundant ones added. Do you realize that if the powers that be get their way, my Remington 870 pump 12ga shotgun which can hold 3 shells will be considered an assault weapon? This is not sensible to me.

As far as the merits of everyone packing a gun as you mentioned, I know some folks who have no business owning a pea shooter much less a gun. Most folks who own guns legally ARE responsible. Yes some are not, but I could say the same about people who drive cars .
