Man gets prison time for part in Charleston armed robbery

CHARLESTON — A Kankakee man received a prison sentence after he admitted taking part in an armed robbery in a Charleston apartment earlier this year.

Andrew Maisonneuve, 20, pleaded guilty to charges of aggravated robbery and residential burglary and was sentenced to six years in prison. Maisonneuve and Derick B. Mitchell, 19, of Chicago were accused of entering an apartment at 950 Fourth St. on March 10, showing a gun and taking video game materials from a man there.

The case against Mitchell, who was an Eastern Illinois University student at the time, is pending and his next hearing is scheduled for Sept. 8. Maisonneuve was not an EIU student, according to information from police at the time of his arrest.

Maisonneuve was originally charged with armed robbery, which requires a prison sentence of six to 30 years when there’s a conviction, but that charge was dismissed.

A four- to 15-year prison sentence was possible for each of the offenses to which he pleaded guilty, and prison time was required for the residential burglary conviction. The aggravated robbery charge alleged that Maisonneuve indicated he or Mitchell had a gun and the residential burglary charge accused him of entering the apartment planning to steal.

Circuit Judge Teresa Righter also ordered Maisonneuve to pay $300 in restitution. The judge imposed the sentence based on a plea agreement that Assistant Public Defender Kerri Davis and Public Defender Lonnie Lutz recommended.

In other recent cases resulting in prison sentences, guilty pleas were also entered by:

n James W. Mowery, 24, 2901 Richmond Ave., to an obstructing justice charge alleging he lied to police when he said there were no females at his residence on May 27.

Mowery, who was sentenced to two years in prison, is a registered sex offender and records in his case said police found a 16-year-old girl in his house. Mowery and the girl both later admitted there had been some sexual contact between them.

Records also show that he was paroled from prison in October after serving a sentence for a conviction for failure to register as a sex offender. Righter accepted a plea agreement that Davis and Lutz recommended.

n Garrett J. Howlett, 19, 207 Vine Ave., Charleston, to an obstructing justice charge alleging he lied about his identity to a police officer on July 18.

Howlett received a one-year prison sentence but has a pending case in which he’s charged with attempted robbery. Records in his case said he gave a false name when the officer tried to arrest him on an outstanding warrant.

Righter accepted a plea agreement that Assistant State’s Attorney Eric Neumann and Lutz recommended. There are no hearing scheduled in the pending case, in which Howlett is accused of hitting a man and trying to steal his wallet on July 12.

Our states atty wouldn't use a liars testimony to get a conviction would he?
The Sa is suposed to seek the truth, not theory. "

U R correct lilly, this punk was a state witness a few months back against Jason Abernathy. Sure hope the jury didn't put much weight into what he had to say. our sa office will stop at no lengths to get a conviction. It isn't about the truth lilly, its about the conviction, power, and money. i will go ahead and throw in cover-ups, scandals, prejudice, discrimination, bribes, sloppy police work, lying officers, lost evidences, drug stealing, plea dealing, corruption at its finest. Once again Lilly, decides that the fact that the records show he did lie to the officer do not matter. Also you might want do research into plea agreements.
Since we do not know if his plea was guilty or no contest. We know how much you dislike the States Attorney, but you might notice that it was the Asst. States Attorney, not the States Attorney himself. Oh well to you, even when wrong they are still right. "

" FYI, Garrett was not a witness against Abernathy, because he was not even in town at the time that Jason did what he did to Gina. Dally, Seeing as to how his age is just now 19, how about you look at the dates on those offenses. Gee, I thought juvenile records were suppose to be sealed, or at the very least I would expect a fine upstanding member of the community such as yourself to not broadcast them.
Also allow me to add that if we are going to be honest 90 percent of the world population has lied to the police at some point..."Do you know why I pulled you over?" " Why no officer I don't. I didn't realize that I was speeding"
I don't suppose that it ever occurred to anyone that he probably has some serious anger issues, after seeing the way his mother was treated and not being able to stop it. Or maybe the fact that he had to hear about what ultimately happened on the news.
While everybody sits on their lofty perch and judges others, allow me to say that not everybody has had such a beautiful and cushy life such as you have. Before being so fast to judge, perhaps you should gather all the facts.
Or you could be the upstanding person you so long to be, and not judge others at all. There is a novel idea... "

" One more thing...Out of this whole article, the first part of which is what caught my attention in the first place, why do more people single out to comment on Garrett? Kamfong is the only comment about the actual cover story. Until now.
For a student, a person who was part of this community for an education, I would think that if driven to such lengths as home invasion robbery, they would be after more than video games. That part is absolutely laughable!!! "

"

" Willow,
So in all honesty, all those charges starting at such a youthful age, Would you call that good parenting or NEGLECT? Apple doesn't fall far from the tree IMHO!

When u say he was out of town, Where was he? Now be honest and say truthfully that he was in prison.
Quit defending this riff-raff! "

Interested Observer wrote on Aug 16, 2009 7:25 PM:

" Mr. Howlett is bad news. The most recent charge-- the attempted robbery one-- resulting from him and three other little thugs bum rushing and trying to rob 2 men who were simply walking down Vine Avenue. This little thug AND his buddies need to be locked away from the rest of society for as long as possible, because anyone who thinks that that sort of behavior is 9in any way acceptable doesn't deserve to be free on the streets! " Garrett is a pretty good person overall. He wasn't raised under ideal conditions. His mother was in prison for making over 900 grams of meth, same with his father. He really never had any real guidance. DCFS should have taken those children long ago. "

" Dally, you are absolutely correct, he was a juvenile home. I never said he wasn't. I simply said he was not in town. And since you know that how about you tell me why you said he was a witness when that was an out right lie? "

willowhall wrote on Aug 17, 2009 8:49 PM:

" Barb, I totally agree with you. I have stated repeatedly in these posts that there is no rehabilitation for a sex offender. Personal Opinion. It is a sickness that cannot be taken away, cured or destroyed. "

" And since you know that how about you tell me why you said he was a witness when that was an out right lie?""

Yes he was in prison, but I think you should check your facts again, as he was present and did testify at the trial. Lies as they were! "

willowhall wrote on Aug 18, 2009 2:38 PM:

" Perhaps you are confused Dally, Travis was a witness, not Garrett. I was at the trial, so I think I would have noticed him. I have been a staunch supporter of Gina through that tragedy, and kept up on all facts. "
