LETTER: Obama breaking the law 'in the public interest'



DON SEARLES, Mattoon

When you borrow money to purchase a house, there is a contract between you and the loan company. The contract states that if you do not pay the loan, the bank can take your house. This is called a security contract. Assume you now run up huge credit card debt and declare bankruptcy. Because they have a security contract, the bank takes the house and your other creditors split up any other assets you have.

The U.S. Constitution in, article 1 section 10, states. “No state shall pass laws impairing the obligation of contracts.” Article 1, Section 8, states. “The congress shall pass uniform laws on the subject of bankruptcies throughout the United States.” Long standing bankruptcy laws clearly state that secured creditors get their money or the assets listed on the security contract and unsecured creditors divide up what is left.

Let’s examine the recent bankruptcy of Chrysler. By law, the secured creditors were to be paid in full or have title to the assets listed on the security contracts and unsecured creditors were to divide up what was left. However, the Obama administration decided “that it was in the public interest” to disregard the constitution and give the secured creditors 29 percent of what they legally had coming.

In New Chrysler, that is to be formed after the bankruptcy, the secured creditors get nothing. The unsecured United Auto Workers will own 68 percent; Fiat, a foreign company who had no claim on the assets and did not invest a dollar, will own 20 percent; and the US and Canadian governments will split the remainder.

What does this mean for you and me?

It means that Obama, who harps on, “Living by the rule of law,” speaks with forked tongue. It is not what he says, but what he does that matters.

It means that we must hold our government to “living by the rule of law,” and not let them break the law based on what they believe is “In the public interest.”

If we let the government continue to break laws based on what they think is, “In the public interest” we will be governed by the whims of those that control the government and become a Socialist nation with the government controlling our jobs, our money, our property, what we say, what we do, when we can see a doctor, and every aspect of our lives. We must take action against this tyranny.

Heck, they even had to manufacture phony evidence to justify spending some of the treasury on a war. Of course the biggest cheerleader in that war, Dick Cheney, managed to become super rich over it. Even the so called Liberal biased media gave him a pass on that one. It took the Republican party almost 6 years to wreck this country. Not since the good old days of Reagan have we seen such numbers.

Apparently it is part of Barack Obamas vetting process to make sure his administration only finds folks who dont pay their taxes to work in government.

His latest appointment to fit this requirement is Capricia Marshall, who has been working for Hillary Clintons Senate and presidential campaigns until now and is President Obamas choice as chief of protocol for the State Department.

While tax evader Tim Geithners appointment to run Treasury/IRS still wins hands down as the most ironic choice (the Turbo tax did it excuse), Marshall comes a close second.

Ms. Marshall has placed the blame for the problem on the Postal Service and on miscommunication between her husband and their accountant.

Mr. Searles presented a well thought out letter about how the current administration destroyed hundreds of years worth of contact law. What does Fox News have to do with the undeniable fact that President Obamas usurped the standard rule of law?

Lets check the handy Tactics for liberals chart to find out why- looks like they are using their old standby #13 tactic (CHANGE THE SUBJECT WHEN YOU ARE LOSING).

That is understandable because it is undeniable fact that in their dealings on Chrysler the current administration has usurped the basic underpinnings of the bond market of lenders being first in line for recovery in the case of a business failure.

Odds are his unilateral rewriting of this basic rule will start a process that greatly increases the risk of an even greater tightening of the credit markets.

A greater risk to loan money decreases the desire of lenders to lend and also forces much higher interest rates on those borrowers that can find a lender.

Kind of like you see with the Federal Reserve having to buy up our own treasury bond offerings with worthless printing press money because the lenders (rest of the world) has wised up to the scam we have been running and is not buying it anymore.

Just what we need in the midst of what appears could become the Greater Depression, even tighter credit markets.

We are far past being broke and running the printing presses 24/7 and Gooberments (local, state and federal) will have to raise taxes soon or go bankrupt- the perfect financial storm.

The last crew on duty was bad, but this crew is really a bunch of overachievers.

Funny, there is only one person in this tirade that could even remotely be considered a potential candidate.

Did an executive order get passed making it now legal for a news channel to run for public office? Is that why you are so intent on trying to make Fox the focus of all debates in all threads?

Sure, it probably concerns you that Fox beats its extreme liberal opposition MSNBC with 3 times the viewers, but it seems that you liberal Dems ought to be more concerned that it finally appears the American public is starting to see through the smoke and mirrors of change for changes sake and I reiterate:

Lyndon Johnson: Allowing National Guard troops to fire upon students protesting the Vietnam war (amendment 1).

Eisenhower: Allowance of the prohibiting the right to vote by those causing intimidation towards the African american community. (article XV section 1) The imprisonment and forced silence of those suspect as "communist" (amendment XIV section 1)

Andrew Johnson: War and removal of Native Americans without congressional approval and against the supreme courts decision supporting the Natives law suit for right to the land they occupied. "

Normally I would agree with you that things move slowly in Washington, but because of the urgency, super-hype and speed that the Democrats passed the $787 Billion stimulus bill (25 days after the inauguration) and the Presidents own statements of why the bill had to be pushed through so quickly that no one even read it:

Add to that the omnibus spending bill of $410 billion that was passed by the House shortly after with 9000 pet projects.

Obama Quadrupled the deficit in 100 Days ($1.8 trillion+, 4 times 2008s record). So yes I think the President, the Democrats and Republicans that voted and signed these should be held to a very high standard of expectations.

I dont expect a complete turnaround in only 6 months but is it really so much to ask that something positive and provable at least start happening after six months?

So far all the green shoots that they have talked about have turned out to be at best withered weeds.

The polls are showing that on the economy the Dems and Obama are no longer perceived positively.

Bush II was an idiot, but the mess we are in took both sides and several presidents to create.

SCOTUS-: The Repub-a-clowns have always talked tuff and rolled over in the end. It is swapping a liberal for a liberal so it seems like it is a push.

Your right there is very little chance that the President will be beaten in the 2012 by a Repub-a-clown.

The MSM is totally in the tank for him so nothing short of a complete economic failure or not responding to an attack on the country would make that a realistic possibility.

For the record, I have never defended Clinton for his suspected cheating or for the one he got busted for. I have often said he should have resigned.

Having said that, I will acknowledge that I have defended him when lies were told about him, such as the story that goes around that he had the opportunity to get OBL but passed on it. There is ample evidence that disputes that claim.

There's an interesting article in todays paper that theorises about why politicians cheat. While this article is based on suppositions, it does make sense, and makes for a good read.

In closing, allow me to point out that some of the stories reported by Fox on line are from the AP. Just as they are on other on line sources such as the liberal Huffington post site as well as all the major TV network web sites. It may have been an AP story, but I read it on Fox on line.

More money has been transferred to the finance capital class by this administration than at any time in planetary history.

But as to his claim for job creation he is either a liar or is being advised by very poor economists.

Want some real world proof it was not a jobs bill?

Large-scale lay-offs in the U.S. (defined as lay-offs of 50 or greater at one time) hit the highest level since this statistic was created in 1995, according to an article from CNN.

This is yet another indication that the U.S. economy is plummeting downward with absolutely no signs of stability, let alone a recovery.

President Obama on the Democrats malignant cap and trade bill- (from President Obamas weekly radio and video address today to praise an energy overhaul bill narrowly passed by the House of Representatives):

"Make no mistake: this is a jobs bill," Obama said in the address.

WRONG AGAIN SIR!

The whole purpose of cap and trade is to hike the price of electricity and gas so that Americans will use less and for tax revenues.

These higher prices will show up not just in electricity bills or at the gas station but in every manufactured good, from food to cars.

Consumers will cut back on spending, which in turn will cut back on production, which results in fewer jobs created or higher unemployment.

Instead of paying his new tax game, some companies will instead move their operations overseas, with the same result.

In only six months they had made a bad situation into an economic disaster!

At their current pace of destruction we will soon start approaching becoming a third world nation- Poverty, No Jobs, No Energy and No Freedom.

My God, what else do they have planned for us between now and 2010? "

That was my point. He is so to the right that he is beyond the right. Like those that are so far left that say, no one on the left has ever done anything wrong. He is one of those that starts out sentences with derogatory remarks. He is truly in a class all his own. In fact years ago I would not have, but anymore I would even put Rush close to that category. Or like visit those fighting men and women who are from her home state. When was the last time Durbin did? When was the last time he went to a fallen soldiers funeral? When was the last time Durbin did anything for Illinois that didn't have to do with Chicago? He is for FutureGen, and look how much that has cost us, without anything to show for it. "

I would have to disagree, his is not the spokesman for the right. You my friend are one of whom I am speaking of. One who can see the forest for the trees. I could not agree with you more. Their are those who post on here that believe those on the right do no wrong either. I have disagreed with them also, and said so. I try not to, though sometimes do fall into it, of making personal attacks. However, I will defend myself and my position. TQ for the most part has a point and makes some valid points to his position. FB on the other hand tends to just agree with others posts. That is where I have the problem. I have never, to my knowledge, called them anything but by their posted name. I get called a "thumper", "right-wing nut", and other such personal attacks. I am not offended with for instance. me and TQ where commenting to each other about the Iraq pull out. Even though I do not agree with his comments I have respect for him in that he stands by his position. Even though he is wrong, sorry cheap shot. That is the thing, whether you agree or not on a topic why the rude remarks about the other. The personal attacks do nothing but show childishness, and take away from the persons credibility. "
