Man admits molesting young girl, gets two years in prison



CHARLESTON — A man received a prison sentence of two years when he agreed to admit that he molested a girl two years ago.

Randall G. Warfel, 40, 739 Buchanan Ave., Charleston, pleaded guilty to a charge of criminal sexual abuse that accused him of fondling the girl in August 2006, when she was younger than 18.

In exchange for his guilty plea, other charges were dismissed, including charges of criminal sexual assault alleging Warfel engaged in acts of intercourse with the girl in August 2005. A conviction for those offenses could have resulted in a prison sentence of four to 15 years.

Circuit Judge Teresa Righter agreed to let Warfel wait until Sept. 5 to report to jail to await transport to prison, and the judge also included $700 in fines in the sentence. Righter accepted a plea agreement that Assistant State’s Attorney Kerri Davis and defense attorney Bob Dunst recommended.

In other cases in court recently, guilty pleas were also entered by: 

- Bradlee A. Rader, 23, for whom records listed addresses on Cedar Avenue in Mattoon and on North Division Street in Charleston, to a charge of aggravated criminal sexual abuse alleging a sex act with a 13-year-old girl on Jan. 28.

A criminal sexual assault charge was dismissed, and a conviction for that offense would have required prison time because it alleged Rader was babysitting the girl and was in a position of authority over her.

There was no agreement on sentencing for the other offense, which Righter scheduled for Oct. 31. Rader could receive a three- to seven-year prison term. Davis is prosecuting the case and Public Defender Lonnie Lutz represents Rader. 

- Ross A. Hutchinson, 19, 44 Deerfield Lane, Charleston, to a misdemeanor charge of obstructing police accusing him of fighting with an officer on March 10.

A felony charge of aggravated battery was dismissed, and terms of Hutchinson’s two-year probation sentence included substance abuse treatment and jail time that was stayed, meaning it won’t be imposed if he follows other requirements. Circuit Judge Richard Scott accepted a plea agreement that Assistant State’s Attorney Mick McAvoy and defense attorney Sean Britton recommended. 

- Jeffrey F. Flenner, 40, for whom records listed addresses at the U.S. Grant Motel and on Lake Land Boulevard, both in Mattoon, to a charge of failure to register as a sex offender.

Flenner admitted he didn’t register his address with police within five days of moving in March, and he received two years of conditional discharge, supervision with fewer restrictions than probation. Terms included six months in jail beginning Monday. Righter accepted a plea agreement that Davis and Lutz recommended.

The victim is a female family member who was under the age of 15 at the time of the rape(s)! This guy should be behind bars for life no parole! Instead, in less than two years, hell be back on the streets and perhaps living in the same home as his victim. Way to go 5th Circuit! Once again, champions of sexually-assaulted youth! "

" I know of a person who recently went to federal prison for 2 counts of downloading child pornography. His sentence 10.5 years and he has to serve no less than 85% of his sentence.

While I believe he deserved jail time for his offense, how do these other people get such light sentences for what most would consider a more aggressive and harsh crime.

I mean, if a guy gets 10 years without ever touching or approaching someone, shouldn't the people committing these heinous crimes be put behind bars for at least 25 years? "

" We need to do more to protect our children, particularly our young girls. Just a few days ago the paper showed a much tougher sentence for the child molester when it involved 2 boys being molested by an adult male. While I was happy to see a predator taken off the streets for a long time, I think it had more to do with our society's fear and loathing of homosexuality than it did with protecting children. I'd be interested to see the statistics involving local cases broken down by gender. In particular, when the child victim is in her teens, I think there are some in the community with the horrendous opinion that the girl somehow asked for it or consented or even initiated the sexual activity. "

As for my comments about Cox there is no love loss between us. Suffice, to say Cox would not lift a finger for my protection would be an understatement. I have no problems with most of Cox's deputies. So, to clarify I hold nothing against them in fact I have helped some of them with their legal needs.
